You can write to us about any privacy matter at info@elevatemedialabs.com. We are not required to appoint a Data Protection Officer; that inbox is the formal channel for exercising your rights, and every request gets an answer.
This policy is governed by:
- Law 81 of March 26, 2019 on Personal Data Protection (Republic of Panama) and its implementing Executive Decree 285 of 2021
- Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR), for individuals located in the European Economic Area
02Our role for each kind of data
We handle three different sets of data, and our legal role is different for each. That difference decides who should handle a complaint.
- Controller: your account data
- Data about the people who use the service. We decide why it is processed, and we answer for it.
- Processor: public information analyzed for a client
- Publicly available content analyzed for a client organization. That organization decides the purpose and is the controller; we process the data on its instructions and under this policy.
- Processor: data from accounts a client connects
- Data from the social media, advertising and messaging accounts a client organization connects to the service. The organization is the controller and authorizes every connection; we process the data on its behalf and on its instructions. See section 5.
03Data about the people who use the service
As controller, we process the following categories:
| Category of data | Purpose | Legal basis | Retention |
|---|---|---|---|
| Identity and work contact details (name, email, phone, job title) | Manage the account, identify the user and communicate with them. | Performance of the contract with their organization. | While the account is active and up to 12 months after it is closed. |
| Credentials and sign-in verification data | Authenticate access and protect the account. | Performance of the contract and our security obligations. | While the account is active. |
| Service preferences | Tailor how information is presented to the user. | Legitimate interest in providing a working service. | While the account is active. |
| Activity and audit logs | Traceability, and preventing and investigating incidents. | Legitimate interest in security, and compliance with legal obligations. | 24 months. |
| Record of acceptance of these terms (date and version) | Prove the consent given. | Compliance with a legal obligation. | While the account is active and 5 years after, as evidence. |
| Technical connection data (IP address, browser, session activity) | Run the service, detect abuse and troubleshoot problems. | Legitimate interest in security and stability. | Up to 90 days. |
| Support communications | Answer questions and resolve issues. | Performance of the contract. | 24 months after the request is closed. |
04Information from public sources
What we process
Content its authors published openly on social networks, digital media, forums and news sites, about the topics each organization hires us to analyze. For each piece of content we process: the published text, its source link, the date, the outlet or platform where it appeared, the author’s public handle, its public metrics, its location when the source makes it public, and the analytical classifications assigned to it.
Where it comes from
Publicly available sources, specialized providers that collect them, and information supplied by the client organization itself. From these sources we never access private communications, private accounts or content that requires someone else’s credentials.
A client’s own accounts are a different case: we access them only with the client’s express authorization, under the terms of section 5. We never read direct messages on Instagram, Facebook, TikTok or LinkedIn.
Legal basis
The client organization’s legitimate interest in understanding and analyzing the public conversation that concerns it (GDPR art. 6(1)(f); art. 4 of Panama’s Law 81, for data from publicly accessible sources). That interest is weighed against the rights of the people involved, with these safeguards:
- we only process content its author made public, and only content about the contracted topic;
- the purpose is analytical and aggregate: measuring the volume, tone and reach of a conversation, not profiling specific people;
- we don’t enrich the information with data from other sources or match it against external databases;
- no automated decisions with legal effects are made about the people involved;
- access is limited to the organization that contracted the analysis.
Retention
For as long as the organization’s contract is in force, with the historical depth that contract sets. When the contract ends, the information is deleted within 90 days unless the law requires us to keep it.
05Connected accounts
A client organization can connect its own social media, advertising and messaging accounts so their statistics sit alongside the rest of its analysis. This section explains what we read from those accounts and the rules we follow.
How an account is connected
- The client authorizes the connection through each platform’s official login, and chooses which accounts, Pages or assets to share.
- We never see or store passwords. The platform gives us an access permission limited to what the client authorized.
- The client can revoke that access at any time, from the dashboard or from the platform itself.
What data we read
| Platform | Data we read | Purpose | Read-only |
|---|---|---|---|
| Professional account profile, the account’s own posts and their metrics, aggregated audience insights, comments and replies on those posts, and posts that mention or tag the account. | Measure the account’s performance and include it in the client’s analysis. | Yes | |
| Facebook Pages | Page details, the Page’s own posts and their metrics, aggregated audience insights, comments and replies on those posts, and posts that mention or tag the Page. | Measure the Page’s performance and include it in the client’s analysis. | Yes |
| Threads | Profile, the account’s own posts and their metrics, replies, mentions and aggregated audience insights. | Measure the account’s performance and include it in the client’s analysis. | Yes |
| Meta ads | Performance of paid campaigns in the ad accounts the client authorizes: spend, impressions, reach, clicks and results. | Include paid media performance in the client’s analysis. | Yes |
| WhatsApp Business | WhatsApp Business account details and phone numbers, message templates, messaging analytics, and the messages sent and received through the integration with their delivery and read statuses. | Send the messages the client sets up, manage its templates and measure messaging performance. | No. It sends messages on the client’s behalf and manages its templates. |
| TikTok | Profile, account statistics, and the list of videos with their cover images, views, likes, comments and shares. For business accounts, also reach, watch time, traffic sources, aggregated audience demographics and comments. | Measure the account’s performance and include it in the client’s analysis. | Yes |
| Company Page statistics, follower counts and aggregated follower demographics, post metrics, comments, and ad campaign performance. If the person authorizes it, also metrics for the posts on their personal profile. | Measure the performance of the Page, its ads and, if authorized, the profile, and include it in the client’s analysis. | Yes |
Audience statistics are always aggregated —counts and percentages, never data about a specific person. We never read direct messages on Instagram, Facebook, TikTok or LinkedIn.
WhatsApp Business
This is the only integration that isn’t read-only, and the only one that involves data about people other than the client. That’s why it has its own rules:
- We process recipients’ phone numbers, the content of messages sent and received through the integration, their delivery and read statuses, and message templates.
- For this data we act as the client’s processor. The client is the controller: it is responsible for having each recipient’s consent (opt-in) and for complying with the WhatsApp Business Messaging Policy and Meta’s Commerce Policies.
- We use this data only to provide the messaging service to that client. Never for any other purpose, and never for any other client.
- Retention: message content and recipients’ phone numbers are kept only as long as needed to provide the service, and no longer than 90 days after each message is sent, or less if the client instructs us to. Aggregated statistics that don’t identify anyone are kept while the contract is in force. Meta, which hosts the messaging platform, keeps messages for up to 30 days to deliver them, under its own terms.
What we never do
With data from connected accounts, we commit not to:
- sell, license or rent it;
- use it for advertising or to profile individuals;
- use it to train artificial intelligence models, whether ours or anyone else’s;
- share it with data brokers or with other clients;
- combine it with data from other sources to identify individuals;
- post or act on behalf of the account, except for sending the WhatsApp messages the client sets up.
Legal basis
Performance of the contract with the client organization, and its express authorization when it connects each account.
Retention
- Access tokens are stored encrypted and deleted as soon as the account is disconnected or access is revoked.
- Metrics, posts and comments are kept while the account stays connected and the contract is in force.
- When the account is disconnected, access is revoked from the platform, or the contract ends, that data is deleted promptly, and in any case within 10 days.
- If a platform notifies us of a revocation or a deletion request, or the account holder asks us directly, we delete the data within that same period.
- Some platforms cap how long certain data can be stored even while the account is connected —LinkedIn, for example, sets limits for posts, comments and reporting data. Wherever a platform’s terms are stricter than this policy, the platform’s rule applies.
How to revoke access
| Platform | How to remove our access from the platform |
|---|---|
| Settings > Security > Apps and websites > Active > Remove (official help) | |
| Facebook Pages | Settings & privacy > Settings > Business integrations > select the app > Remove (official help) |

Platform terms
Our use of this data is also subject to each platform’s terms:
- Meta: Platform Terms · Developer Policies · Meta Business Messaging Technology Provider Terms · WhatsApp Business Solution Terms · WhatsApp Business Messaging Policy · Commerce Policies
- TikTok: TikTok Developer Terms of Service · TikTok Developer Data Sharing Agreement · TikTok API for Business terms
- LinkedIn: API Terms of Use · Marketing Developer Terms
Each platform also processes this data under its own privacy policy: Meta · Instagram · Threads · WhatsApp · TikTok · LinkedIn.
06Automated processing
The service uses automated processes, including artificial intelligence systems, to classify and summarize the information analyzed.
- None of these processes has legal effects on, or significantly affects, the people whose content is analyzed. Their output is input for analysis, and a person can review and correct it.
- Information processed by these systems is not used to train third-party models.
- If these systems are applied to comments from connected accounts —for example, to classify their tone— the same applies: no legal effects on anyone, and no training of third-party models. That data isn’t used to train our own models either.
- You can object to this processing as explained in Your rights.
07Who we share data with
We don’t sell personal data or share it for advertising. We only disclose it to the providers we need to run the service, each bound by a data processing agreement and a duty of confidentiality, and acting on our instructions. They fall into these categories:
- Technology infrastructure: hosting, databases and storage
- Artificial intelligence services
- Providers of information from publicly available sources
- Technical support and security tools
- Communication and notification services
- Authentication service providers
Data from connected accounts is shared only with the infrastructure providers needed to run the service, under these same conditions, and never for advertising.
We may also disclose data to competent authorities when a law or court order requires it.
08International transfers
Some of these providers process data outside Panama and the European Economic Area. Those transfers rely on:
- Standard Contractual Clauses approved by the European Commission, for individuals covered by the GDPR;
- the contractual confidentiality and security guarantees required by article 12 of Panama’s Law 81, including the provider’s obligation to apply an equivalent level of protection;
- the transfer being necessary to perform the service contract.
You can ask for a copy of the applicable safeguards at info@elevatemedialabs.com.
09Security
We apply technical and organizational measures appropriate to the risk, in line with GDPR article 32 and article 6 of Law 81, including access control, encryption, separation of each organization’s information, traceability and regular review of how well they work. For security reasons we don’t publish how they are configured; we describe them to client organizations under the data processing agreement.
No system is invulnerable. If a security breach puts your rights at risk, we’ll notify you and the competent authority within the legal deadlines.
10Your rights
You can exercise the following rights at any time, free of charge:
- Access
- Know what data about you we process and get a copy.
- Rectification
- Correct inaccurate or incomplete data.
- Erasure
- Have your data deleted when it is no longer needed or the processing is unlawful.
- Objection
- Object to processing based on legitimate interest. Unless we can show compelling grounds, we stop.
- Restriction
- Ask us to pause processing while a challenge is resolved.
- Portability
- Receive the data you gave us in a structured, commonly used format.
- Withdrawing consent
- Where processing is based on your consent, withdraw it without affecting the lawfulness of what came before.
How to exercise them
Write to info@elevatemedialabs.com saying which right you want to exercise. We may ask you to confirm your identity, only so we don’t hand your data to someone else. We reply within 30 calendar days; if the request is complex, we’ll tell you and the deadline may be extended by another 30 days.
To ask us to delete data from a connected account —or, if you aren’t a client, your comment or your messages— follow the steps on the Data Deletion page.
Complaints to a supervisory authority
You can file a complaint with Panama’s National Authority for Transparency and Access to Information (ANTAI). If you live in the European Union, you can go to your country’s supervisory authority —in Spain, the Agencia Española de Protección de Datos. You don’t need to contact us first, though we’d appreciate the chance to fix it.
12Children
The service is meant for professional use, not for minors, and we don’t open accounts for them. Posts by minors may appear in the public content analyzed; we don’t identify them or single them out as a category.
13Changes to this policy
When we change this policy we publish the new version on this page with its date. If the change materially affects how your data is processed, we let you know and ask you to accept the new version before you continue.
