02What the Platform is

The Platform is a cloud service that gives client organizations a private workspace with analysis of publicly available information and the reports built from it. When an organization authorizes it, the Platform also brings in data from accounts the organization owns and connects.

The exact scope of each account is set out in the services agreement signed with the organization. These terms govern how the Platform is used. They don’t replace or amend that agreement, and if the two conflict, the agreement prevails.

03Access and accounts

Access is by invitation only. Accounts are created by us or by an administrator the client organization designates. There is no public sign-up.

Credentials are personal and belong to a single person. You are responsible for keeping them safe and for everything done with them. If you suspect someone else has accessed your account, tell us right away at info@elevatemedialabs.com.

We may require additional verification to access the Platform and change those requirements when security calls for it.

04Acceptable use

When using the Platform, you agree not to:

  • access, or try to access, information belonging to an organization other than your own;
  • extract information in bulk or by automated means, or by any means other than those the Platform provides;
  • reverse engineer, decompile or try to work out how the Platform operates internally;
  • circumvent security, access or usage-limit controls;
  • use the information to harass, unlawfully profile or retaliate against anyone;
  • resell or transfer your access, or the information you obtain, without our written permission;
  • upload unlawful or malicious content, or content that infringes the rights of others.
The information analyzed comes from public conversations between real people. Something being public doesn’t make it fair game for any purpose: use it only for the analytical purpose the service was contracted for.

05Who owns the information

The client organization’s information, and the reports it produces, belong to the client organization. We don’t acquire any ownership over them.

The organization grants us a limited, non-exclusive, revocable license to host and process that information for the sole purpose of providing the service. We may use aggregated, anonymized statistics to operate and improve the Platform, as long as they can’t identify the organization or any person.

Personal data is handled as described in the Privacy Policy, which forms part of these terms.

06Third-party content

The information analyzed comes from content its authors made public, and it belongs to them. We don’t guarantee it is complete, accurate or permanent: sources can edit, correct or remove content, and those changes show up as each source reports them.

07Connecting third-party accounts

A client organization can connect its own social media, advertising and messaging accounts to the Platform. Each time it connects an account, the organization represents that:

  • it owns the account or is an authorized administrator of it; and
  • it has the right to share that account’s data with us for the purposes of the service.

The organization can disconnect any account at any time, from the dashboard or from the platform itself. Data obtained from connected accounts remains the organization’s. What we read, how long we keep it and what we never do with it is set out in the Privacy Policy.

08WhatsApp messaging

If a client organization connects its WhatsApp Business account to send messages through the Platform, it is responsible for:

  • the content of the messages it sends;
  • obtaining, and keeping a record of, each recipient’s consent before messaging them;
  • complying with the WhatsApp Business Messaging Policy and Meta’s Commerce Policies;
  • the messaging charges Meta bills to its account.

We may suspend message sending if we detect use that breaches those policies.

09Reliance on third-party platforms

Our integrations depend on Meta, TikTok and LinkedIn. If a platform changes, limits or shuts down access to its API, some features or metrics may stop being available. That is not a breach on our part.

Use of each integration is also subject to that platform’s own terms:

10Analytics and automated outputs

Some features produce results through automated processes, including artificial intelligence systems. Regarding those results:

  • They are estimates and may contain errors. They don’t replace professional judgment and are not legal, financial or communications advice.
  • Any significant decision should be reviewed by a person.
  • Some figures are shown as estimates and are labeled as such in the Platform; they shouldn’t be read as numbers reported by the source.
  • Content processed by those systems is not used to train third-party models.

11Availability and support

We aim to keep the Platform available at all times, but we can’t promise it will be uninterrupted. There may be maintenance windows, incidents outside our control and outages at information sources.

Any service-level and support commitments are those in the services agreement. Where there is no specific agreement, the Platform is provided as is.

12Intellectual property

The software, design, brand, documentation and analysis methodologies belong to ELEVATE MEDIA LABS, S.A. or its licensors. Access to the Platform doesn’t transfer any of those rights.

The reports an organization produces are its own, and it can use, publish and share them freely in the course of its business.

13Confidentiality

Each party will keep confidential any confidential information of the other that it accesses through the service, and won’t disclose it unless required by law. On our side, one organization’s information is never shared with another client organization or used in marketing materials without written permission.

14Suspension and termination

We may suspend or cancel access for a serious breach of these terms, for use that puts the security of the service at risk, or for non-payment under the services agreement. Unless there is a justified emergency, we give notice first.

When the relationship ends, the organization can ask for its information to be returned within thirty (30) days. After that, it is deleted within the periods set out in the Privacy Policy.

15Warranties and limitation of liability

The Platform is an analysis tool. We don’t guarantee any commercial, reputational or business outcome from using it, or that it will detect every piece of content that exists on a subject.

To the extent the law allows, our total liability to a client organization for any claim related to the service is limited to the amount that organization actually paid in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect damages, lost profits or lost business opportunities.

Nothing above limits liability for willful misconduct, gross negligence, personal injury or anything else the law says cannot be waived. If you are a consumer in the European Union, you keep all the rights the law of your country of residence gives you.

16Changes to these terms

We may update these terms. Every document carries a version number and a date. When a change is material, you’ll be asked to accept the new version before you keep using the service, and that acceptance is recorded with its date and version. Minor wording fixes only change the “last updated” date.

17Governing law and jurisdiction

These terms are governed by the laws of the Republic of Panama. The parties submit any dispute to the courts of Panama City and waive any other venue.

Personal data is also governed by the laws listed in the Privacy Policy:

  • Law 81 of March 26, 2019 on Personal Data Protection (Republic of Panama) and its implementing Executive Decree 285 of 2021
  • Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR), for individuals located in the European Economic Area

If you are a consumer resident in the European Union, this clause doesn’t take away the protection of the mandatory laws of your country or your right to bring a claim in the courts where you live.
